By accessing or using our Services, you agree to be bound by this Agreement.

1 Acceptance of This Agreement

By accessing or using our Services (or by clicking “accept” or “agree” when prompted), you agree to be bound by the terms and conditions of this Agreement. If you do not agree, you should immediately stop using our Services.

1.2 Eligibility

To use our Services, you must be at least 18 years of age, be legally capable of entering into a binding agreement, and use our Services only for lawful purposes. By accessing our Services, you represent and warrant that you meet these requirements.

Us To You Mobile Health reserves the right to update this Agreement at its sole discretion. We will provide reasonable notice of any material changes. Your continued use of the Services after changes become effective constitutes your acceptance of the revised Agreement.

Our Services may change from time to time as we evolve and add new features. We reserve the right to modify or discontinue any part of the Services at any time without notice. We shall have no liability to you for any losses caused by unavailability of the Services.

Creating an Account

Certain features may require you to register for an account. You agree to provide accurate, complete, and up-to-date information. All information provided will be governed by our Privacy Policy.

Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use of your account. We are not liable for losses resulting from your failure to protect your account information.

3 Acceptable Use Policy

You may use our Services for lawful purposes only. You agree NOT to:

  • Impersonate others or misrepresent your affiliation with any person or entity

4 Healthcare Services & Appointment Policy

Nature of Services

Us To You Mobile Health provides mobile healthcare services including IV Hydration Therapy, Weight Loss programs, Covid/Flu/RSV treatment, Asthma care, and Allergy/Allergic Reaction treatment. Our services are provided by board-certified healthcare providers.

Appointment Booking

By booking an appointment, you agree to provide accurate health and contact information. You are responsible for ensuring that the location provided for your appointment is safe and accessible for our providers.

Cancellations

Please provide adequate notice if you need to cancel or reschedule an appointment. Failure to provide reasonable notice may result in a cancellation fee as outlined at the time of booking.

Medical Disclaimer

Our Services do not replace your primary care provider. In the event of a medical emergency, please call 911 immediately. Information provided through our website is for general informational purposes only and should not be construed as medical advice.

5 Payment & Billing

Payment

Payment is required at the time services are rendered unless otherwise agreed upon in writing. We accept major credit cards and other payment methods as indicated at the time of booking.

Payment Issues

If a payment method is declined, we will attempt to contact you to resolve the issue. Outstanding balances may result in suspension of future services until resolved.

Refunds

Refund requests will be reviewed on a case-by-case basis. Please contact us directly at (210) 420-0210 to discuss any billing concerns.

6 Intellectual Property

All content on our website including text, graphics, logos, images, and software is the property of Us To You Mobile Health and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any of our content without our prior written permission.

You are granted a limited, non-exclusive, non-transferable license to access and use our website for personal, non-commercial purposes only.

7 User Content

If you submit reviews, comments, or other content through our website, you grant us a non-exclusive license to use, display, and share that content in connection with our Services. You are solely responsible for any content you submit and agree that it will not:

  • Violate any applicable laws or regulations
  • Infringe on any third-party intellectual property rights
  • Contain false, misleading, or defamatory statements

10 Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN “AS-IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. US TO YOU MOBILE HEALTH DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SERVICES IS ENTIRELY AT YOUR OWN RISK.

11 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, US TO YOU MOBILE HEALTH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE OUR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOUR SOLE REMEDY FOR DISSATISFACTION WITH OUR SERVICES IS TO STOP USING THEM.

12 Indemnification

You agree to indemnify, defend, and hold harmless Us To You Mobile Health and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your violation of this Agreement, or your violation of any rights of a third party.

13 Governing Law & Dispute Resolution

Governing Law

This Agreement is governed by and construed in accordance with the laws of the State of Texas, without giving effect to any conflict of law principles.

Dispute Resolution

Any disputes arising out of or related to this Agreement or our Services shall be resolved first through good-faith negotiation. If a resolution cannot be reached, disputes shall be brought exclusively in a state or federal court located in the State of Texas. You hereby submit to the personal jurisdiction of such courts.

Time Limit to File Claims

Any claim arising out of or relating to this Agreement must be commenced within one (1) year after the cause of action arose; otherwise, such claim is permanently waived and barred.

YOU UNDERSTAND THAT BY AGREEING TO THESE TERMS, YOU ARE WAIVING THE RIGHT TO TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION LAWSUIT.

14 Miscellaneous

  • Entire Agreement: This Agreement constitutes the entire agreement between you and Us To You Mobile Health regarding your use of our Services.
  • Severability: If any provision of this Agreement is found invalid or unenforceable, the remaining provisions will continue in full force.
  • Waiver: Our failure to enforce any provision of this Agreement shall not constitute a waiver of that provision.
  • No Agency: Nothing in this Agreement creates a partnership, joint venture, or agency relationship between you and Us To You Mobile Health.
  • Assignment: You may not assign your rights under this Agreement without our prior written consent. We may assign our rights at any time.
